Jim Bidwell, Inc.'s major area of assistance is in claims analysis and documentation in support of construction litigation and arbitration. In this capacity the company uses scheduling, estimating, and project oversight techniques to support construction claims.
Existing client documentation is analyzed and, depending upon the complexity and the number of documents, a computer indexing system is used to organize the documents. Using input from the client's field and office personnel, the documentation package, and estimating, scheduling, and construction management theory, JBI organizes the information into a concise claim or claim defense report.
In preparation of its reports, the company uses design graphics support to create a visual picture of events. The graphics are sometimes invaluable in the presentation of data to arbitrators, judges, or juries.
For the contractor client JBI puts your arguments together in the best light. We support your attorney. If you have not yet chosen an attorney, we can refer you to the best attorney available to support your particular area of need.
In support of attorney's we prepare drafts, produce expert opinion reports and provide expert testimony on the reports, and answer technical pleadings. We frame deposition positions, prepare questions for depositions, review the depositions of opposing experts, aid in designing litigation strategy, produce and bring together graphics for display in court or at arbitration, and assist in the preparation of cross examination questions.
Jim Bidwell, Inc. offers Complex case Litigation Management Support services to parties in construction litigation and arbitration disputes. The service assists a disputing party in tracking, supporting, and monitoring its litigation team. This coordination helps to insure that the activities of the team are focused, complimentary, and it helps to minimize duplication of effort. The service also provides document management and control, witness coordination, and deposition transcript management.
JBI assists in assembling questions for witnesses, interviews witnesses, and attends depositions. We summarize and critique testimony to assist you in understanding the importance of the testimony in proving your position. We collect all documents available from you or any provided by your opposition and organize and compile these documents to facilitate the retrieval necessary to assist in supporting your positions. JBI is capable of screening documents into a single data base for case management purposes and can also document case histories through chronological reconstruction of events. JBI also summarizes the content of the documents in a manner designed to facilitate their retrieval to assist in witness questioning or for illustrating the client's positions at arbitration, or in court.
JBI creates coordination letters to project attorneys to inform the various client attorneys of the work activities of the other project attorneys. This task assists in avoiding duplication of efforts.
Jim Bidwell, Inc. assists in the location, screening and hiring of appropriate expert witnesses. We coordinate expert witness work activity to divide the areas of analysis between the various experts to insure that each expert addresses the area of expertise with little or no overlap.
We monitor each expert witness' activities, convey the results of the expert analyses to the client, and assist the attorneys in understanding the potential for maximizing the client's position.
JBI serves as a clearinghouse for the receipt of legal analysis, briefs, expert reports, and monthly status reports to assure that the client's position is being advocated in a consistent, cost effective, and clear manner.
