Arbitration
ARBITRATION is an adjudicatory process in which a neutral third party is empowered to render a final and binding decision after hearing all of the evidence, arguments, and proofs of the disputing parties.
Arbitration is part of the continuum of Dispute Resolution tools available and always follows Mediation at JBI.
JBI offers mediation, arbitration, and partnering services to its clients. Jim Bidwell has participated as mediator, arbitrator, advocate or claims analyst and expert witness in well over one hundred arbitration and mediation proceedings in cases involving construction disputes. Mr. Bidwell has participated in cases ranging in size from $20,000 to more than $6,000,000. In the first international commercial mediation effort in Honolulu, involving a sovereign nation's resolution of a business dispute, he was successful, in a mediation that lasted twenty hours, in settling the dispute and saving the parties an estimated $500,000 in additional attorney's fees and at least a month of adversary proceedings.
Mr. Bidwell serves as a neutral for the Distinguished Panel of Neutrals for Dispute Prevention & Resolution and on the Construction and Commercial Panels of the American Arbitration Association.
